Perkawinan, dalam tradisi hukum Islam, bukan sekadar akad yang menghalalkan relasi antara laki-laki dan perempuan, melainkan institusi normatif yang sarat dengan dimensi teologis, etis, sosial, dan yuridis. Dalam khazanah fiqih klasik, para fuqaha telah merumuskan konstruksi hukum perkawinan dengan pendekatan metodologis yang ketat, berbasis pada Al-Qur’an, Sunnah, ijma’, dan qiyas. Namun, perubahan konteks sosial, perkembangan ilmu pengetahuan, serta transformasi relasi gender menuntut adanya pembacaan ulang melalui perspektif fiqih kontemporer yang lebih responsif terhadap prinsip keadilan, kemaslahatan, dan perlindungan hak asasi manusia.
Di sisi lain, pembaruan hukum nasional melalui lahirnya Kitab Undang-Undang Hukum Pidana (KUHP Baru) menghadirkan konfigurasi norma yang beririsan dengan ranah privat keluarga. Regulasi mengenai kesusilaan, kohabitasi, dan relasi dalam ruang domestik menunjukkan bahwa negara tidak lagi sekadar menjadi pengatur administratif perkawinan, tetapi juga memasuki wilayah moralitas sosial. Fenomena ini memunculkan pertanyaan mendasar: sejauh mana intervensi negara dapat dibenarkan dalam institusi yang secara teologis sakral dan secara sosiologis intim? Bagaimana harmonisasi antara norma agama, norma sosial, dan norma pidana dalam menjaga keseimbangan antara perlindungan dan kebebasan?
Buku ini berupaya menjawab pertanyaan-pertanyaan tersebut melalui pendekatan multidisipliner. Pertama, kajian fiqih klasik digunakan untuk menelusuri fondasi normatif dan historis pembentukan hukum perkawinan dalam Islam. Kedua, pendekatan fiqih kontemporer dihadirkan untuk mengeksplorasi dinamika ijtihad dalam merespons isu-isu modern seperti kesetaraan hak, perlindungan pihak rentan, dan restrukturisasi peran dalam keluarga. Ketiga, analisis terhadap KUHP Baru dilakukan untuk memahami pergeseran paradigma hukum pidana dalam memaknai relasi keluarga. Keempat, pendekatan sosiologi kontemporer digunakan untuk membaca problematika keluarga modern—mulai dari meningkatnya angka perceraian, pergeseran nilai, tekanan ekonomi, hingga digitalisasi relasi—sebagai realitas empiris yang memengaruhi konstruksi hukum dan praktik perkawinan.
Buku ini tidak hanya memotret perkawinan sebagai teks normatif, tetapi juga sebagai fenomena sosial yang hidup dan bergerak. Perkawinan ditempatkan dalam lintasan perubahan—antara tradisi dan modernitas, antara sakralitas dan rasionalitas hukum, antara moralitas agama dan regulasi negara. Dalam konteks ini, penulis berupaya menghadirkan analisis yang sistematik, argumentatif, dan reflektif, dengan harapan dapat memberikan kontribusi akademik bagi pengembangan hukum keluarga Islam serta diskursus pembaruan hukum nasional.
